James Kelly per ship Isabella, under sentence of 14 years, in the service of Mr. Patrick Reilly charged with disobedience of the orders of his mistress and obstructing the constables in the execution of their duty. James Stevens per ship Norfolk, in government service charge with aiding and abetting in the outrageous conduct of James Kelly. Chief Constable George Muir states - I was informed this morning that Kelly was conducting himself in a disorderly manner at Mr. Reillys. I went there and found Mrs. Reilly and Kelly in the store room. She accused him of being drunk and said she suspected he had been drawing off some wine from a cask. I examined the cask and under it I found a good deal of wine and there was a wooden spiggot in the cork hole. Mrs. Reilly desired Kelly to leave the house and go to the mill until Mr. Reilly s return from Sydney and she weighed his mess to take with him. He absolutely refused to go upon which she desired me to take charge of him. I directed the constables with me to take him into custody, but he resisted and struck one of them on the face, who not having his staff seized a stick that was near but by my orders he relinquished it without using it. At this moment Stevens came forward and made use of very violent threats as to the manner in which he would treat the constables if they were to meddle with him. - Gives Stevens a good character. Francis Macnamara states - I went this morning with the Chief Constable and was assisting to take Kelly into custody. He refused to go. On my laying hold of him he struck me with his fist on the mouth and dicked me and forced me against the door. I seized a stick to defence myself but the chief constable directed me not to sue it. Stevens then came up and expressed himself in very violent terms as to what he would do if any constable attempted to lift a stick against him - following us to the Hall door repeating the same language. Kelly makes no defence. Stevens states - I cried - Shame - when I saw McNamara take the bludgeon in his hand that was I said...Sentence - James Kelly 50 lashes; James Stevens one month in the gaol gang
